From July 2015 to May 2017 Fort Smith residents were charged for their curbside (single stream, mixed, all-in-on, roll-out) recycling, that went to the landfill. But AR Supreme court overturned the case. Therefore it is legal in Arkansas to charge for recycling that goes to the landfill if recycling and garbage are on the same line on the bill. Case: AR Supreme Court ruling, City of Fort Smith vs. Merriott 2023 AR 51 660 S.W. 3rd 809 (2023).
